What is a regulation in Turkish law?
A regulation implements statutes or presidential decrees within competent authorities’ functions. Constitutional Article 124 provides its Turkish basis. It differs from a statute and cannot contradict its legal foundation. The title regulation does not automatically establish every provision’s legality.
Authority and scope
1. Issuing authorities The President, ministries and public legal persons may issue regulations under constitutional conditions and within their functions. A private organization’s similarly named internal rules do not automatically acquire the same public-law status. 2. Relationship with statutes Regulations can supply implementation details without exceeding authority or contradicting superior rules. Examine enabling legislation or decrees alongside the regulation. 3. General rules Regulations establish general, abstract rules, unlike an individual permit. Both the underlying rule and its application may matter in one dispute.
Publication and review
4. Commencement Statute determines which regulations require Official Gazette publication. Publication, commencement and transitional provisions require separate examination. Older online copies may omit amendments. 5. Judicial review Challenges depend on jurisdiction, standing and deadlines. Remedies associated with implementing decisions have specific rules. Alleged illegality does not invariably suspend implementation automatically. 6. Practical reading Identify title, date, enabling authority and article. Circulars, communiqués and regulations differ. Compare documents against the rules effective at the relevant time; specific remedies require case details.
