What are fundamental rights and freedoms?

Fundamental rights constitutionally protect dignity, freedom and participation. They include life, privacy, expression, property and access to justice. Their scope and state obligations differ. In Türkiye, the Constitution, relevant statutes and applicable human-rights treaties require combined consideration.

Understanding scope

1. Noninterference and protection States may need both to avoid interference and protect people from particular dangers. These create different duties. A right’s existence does not automatically prescribe one outcome in every case. 2. Different rights Personal, political, social and economic categories address different needs but overlap. Information, expression and remedies can arise together. 3. Rights holders Some protections apply to everyone, while others have specific conditions. Legal persons’ protections depend on the right’s nature. Examine provisions rather than relying on headings.

Restrictions and remedies

4. Restriction conditions In ordinary circumstances, constitutional Article 13 and each right’s special provisions matter. Legal basis, essential content and proportionality are considered together. Rights cannot all be restricted identically. 5. Competing interests Expression and privacy may intersect. The response is reasoned legal assessment rather than automatically ignoring one side. Public-interest language does not authorize unlimited interference. 6. Effective protection Administrative and judicial remedies have different prerequisites. Constitutional individual applications also have admissibility conditions. Preserve documents and assess deadlines promptly; a general rights overview does not itself satisfy procedural requirements.
