What is an employment contract?
An employment contract exchanges dependent work for wages. Turkish Labour Law 4857 is an important source, with other statutes and exceptions for some work. Actual features matter more than labels: independent services and employment are different relationships.
Formation and content
1. Dependence Organization, instructions and actual conditions inform classification. Calling a document consultancy does not alone exclude employment. Nor is every service provider automatically an employee. 2. Writing Some contracts have formal requirements. Absence of a written document does not universally eliminate the relationship. Documenting wages, duties and conditions helps clarify disputes. 3. Types Fixed-term, indefinite, full-time and part-time work have different requirements. Fixed terms need statutory assessment; an end date alone does not settle classification.
Duties and ending
4. Reciprocal duties Payment, work, care and loyalty can arise. Employer managerial powers are limited by safety, equal-treatment and personality protections. 5. Hours and leave Working time, overtime and rest have special rules. Contracts cannot waive every mandatory protection. Payroll, records and actual working arrangements require combined assessment. 6. Termination Resignation, notice termination and termination for justified reasons differ. Not every departure creates identical compensation or reinstatement rights. Assess deadlines and applicable mediation prerequisites promptly; templates cannot replace the facts.
