What is mediation?

Mediation supports communication through an independent, impartial third person while parties seek a solution. Mediators do not impose judgments. Turkish Law 6325 is the main civil-dispute framework, and not every dispute is suitable.

Types and principles

1. Voluntary mediation Parties can choose mediation for suitable private-law matters. Issues outside their free disposition cannot all be settled this way. Disputes involving allegations of domestic violence have a specific exclusion. 2. Litigation prerequisites Some statutory categories require an application before litigation, not compulsory agreement. Check current scope, exceptions and procedures; employment and consumer matters are not all identical. 3. Impartiality and confidentiality Mediators respect equality. Confidentiality and restrictions on later evidentiary use apply within defined scopes and exceptions. A document does not automatically gain identical protection merely by being shown during talks.

Negotiation and outcomes

4. Preparation Clarify claims, calculations and documents beforehand. Lawyers can help evaluate options. Mediators do not act as one party’s advocate or guarantee outcomes. 5. Settlement documents Specify payments, dates, scope and obligations clearly. Binding effect and enforceability depend on signatures, dispute type and statutory conditions. Signed minutes do not all have identical consequences. 6. No agreement Further remedies may remain available; final records matter. Effects on limitation and forfeiture periods have special rules. Verify dates, prerequisites and scope against the specific file.
